Office for Planning and Supervision of Implementation of Article 44

The mission, responsibilities, and organizational chart of the Office for Planning and Supervision of Implementation of General Policies Pertaining to Article 44 of the Constitution (Secretariat of the Supreme Council for Implementation of General Policies Pertaining to Article  44 of the Constitution).

 

Mission:

The Office of Planning and Management for Implementation of the General Policies Pertaining to Article 44 of the Constitution of the Islamic Republic of Iran has been established with the goal of functioning as the secretariat for the Supreme Council for Implementation of General Policies Pertaining to Article 44 of the Constitution* (outlined in clause 2 of article 41 of the revision of aspects of the Law for the fourth economic, social, and cultural development plan of the Islamic Republic of Iran and the Implementation of the General Policies Pertaining to Article 44 of the Constitution, passed in 1387/2008).

This secretariat is also legally responsible to act as secretariat for the Committee for Supervision of Deregulation [Hay’at-e Nezaarat bar Moghararaat zedayi].

*  Translator’s note: the “Supreme Council for Implementation of General Policies Pertaining to Article 44 of the Constitution” will hereafter be referred to as “Supreme Council for Implementation” in this text.

Responsibilities

·       Creating and editing of the final draft of all executive provisions, including bylaws, directions, workbooks, and criteria regarding the rights and responsibilities of the Supreme Council for Implementation, to be presented to the mentioned council for its approval.

·       Proposing annual executive policies to the Supreme Council for Implementation and presentation to this council for handing down decisions.

·       Commissioning the necessary expert studies (if needed, by using consultant services) in order to provide the necessary analysis and recommendations to the Supreme Council for Implementation.

·       Creating content of meeting agendas; composing invitations for the meetings of the Supreme Council; and drafting the ensuing meeting notes.

·       Drafting and editing the legislations of the Supreme Council for Implementation to be communicated by the Council secretary.

·       Creating and updating an information bank on the legislations and decisions of the Supreme Council for Implementation.

·       Follow-up, coordination, and the necessary efforts for cultural-informational programs in the framework of the General Policies Pertaining to Article 44 of the Constitution

·       Design and regulation of practical indicators for monitoring and supervision of the realization of the General Policies Pertaining to Article 44.  Also, the recommendation of these [indicators] to the Supreme Council for Implementation for approval.

·       Follow-up on assigned affairs with executive bodies regarding the Supreme Council for Implementation’s responsibilities, decisions, and legislations.  Also, drafting periodical reports for presentation to the appropriate authorities.

·       Handling the affairs of the secretariat of the Committee for Supervision of Deregulation.

·       Conducting all other affairs assigned by the Supreme Council for Implementation’s secretary (Minister of Economic and Financial Affairs) in order to realize the mission and responsibilities of the Supreme Council for Implementation .

Responsibilities of Different Groups:

Group for Macro Analysis and Investigations:

1.       Drafting the necessary expert reports to present to higher authorities and the Supreme Council for Implementation.

2.      Preparing analysis reports and macro and thematic articles in order to make recommendations for advancing the missions and responsibilities of the respective ministries and the Supreme Council for Implementation, regarding the Law of Implementing the General Policies Pertaining to Article 44 of the Constitution.

3.      Providing expert opinion to executive bodies in areas where there are questions and ambiguities.

4.      Actively participate in meetings to advance the programs of the Law for Implementing the General Policies Pertaining to Article 44 of the Constitution.  Also, presenting [meeting] reports.

5.      Communication with executive bodies to understand and obtain their plans and to summarize relevant reports.

6.      Sponsoring meetings for executive bodies to brainstorm and exchange views on the formulation of annual policies and strategies for [the executive bodies].

7.      Preparing annual executive policies and strategies for implementing the General Policies Pertaining to Article 44 of the Constitution to recommend to the Supreme Council for Implementation.

8.      Organizing conferences, theoretical and applied meetings, and instructional workshops on the topic of the Law of Implementing the General Policies Pertaining to Article 44 of the Constitution and active participation in these kinds of meetings.

9.      Studying and identifying strengths and weaknesses in implementing the General Policies Pertaining to Article 44 of the Constitution and preparing and presenting the necessary reports on this matter.

10. Handling all other affairs assigned by the relevant authorities.

Group for Executive, Cultural, and Public Relations Affairs

Preparing the content of meeting agendas; drafting and sending of invitations; and organizing the meetings of the Supreme Council for Implementation; and handling all other secretariat affairs of that Council.

1.      Drafting legislation for the Supreme Council and other relevant legal policymaking authorities; follow-up on the decrees and implementation of these legislations.

2.      Creating an information bank for the legislation and decisions of the Supreme Council for Implementation.  This [should include] legislations and executive regulations of other related decision-making authorities.

3.      Preparing and extending invitations for meetings of the expert commission [komission-e takhasosi-e shoray-e aali] of the Supreme Council for Implementation, as well as organizing the meetings and preparing meeting agendas, conclusions, and decisions.

4.      Creating an information bank for petitioners and those present at meetings.  This includes [meetings of] the expert commission of the Supreme Council for Implementation, as well as meetings with representatives of various executive bodies.

5.      Coordinating with the media; production of a newsletter and bulletin of news and information regarding Article 44; and sorting and presenting this material to higher officials and related authorities.

6.      Active participation in setting up the website of Article 44 in the respective ministry and completing and updating of the site’s information from various sources.

7.      Following-up on the proper implementation of decisions and edicts issued by the Supreme Council for Implementation to organize the cultural and public relations aspects of implementing the General Policies Pertaining to Article 44 of the Constitution.

8.      Active participation in organizing conferences; theoretical, practical and educational meetings; and dissemination of information regarding topics related to the Law of Implementing the General Policies Pertaining to Article 44 of the Constitution.

9.      Handling all other tasks assigned by the relevant authorities.

 

Group for Drafting and Re-Evaluating Laws and Regulations

Preparing and arrangement of the draft of executive requirements – which includes bylaws, instructions, workbooks, and necessary criteria – to recommend to the relevant legal authorities for approval and drafting of laws.

1.      Providing legal and technical opinion regarding applied laws and regulations related to the General Policies Pertaining to Article 44 of the Constitution.

2.      Editing the legislations of the Supreme Council for Implementation in order to be issued by the Council secretary.

3.      Cooperating in updating the information bank of the legislations and decisions of Supreme Council for Implementation and the decisions of other related legal authorities.

4.      Cooperating in follow-through, coordination, and preparation of the necessary prerequisites to correctly implement the law within the framework of the General Policies Pertaining to Article 44 of the Constitution by executive bodies and other related authorities.

5.      Handling the secretariat affairs of the Committee for Supervision of Deregulation which includes preparing the contents of meeting agendas; drafting and extending invitations for their meetings; organizing the meetings; editing the meeting notes; and forwarding [the notes] to the relevant offices.

6.      Following-up on the decisions and decrees from the Committee for Supervision of Deregulation to the executive bodies and other related officials.  Also preparing the related needed reports.

7.      Active participation in meetings for editing or correcting the rules and regulations of the General Policies Pertaining to Article 44 of the Constitution in order to provide recommendations and opinions, and to report [on their proceedings] to higher officials.

8.      Identifying objections to the implementation of – or confusion in the rules and regulations relating to – the General Policies Pertaining to Article 44 of the Constitution.  Presenting the necessary reports and recommendations to rectify these objections.

9.      Presenting proper and timely recommendations and opinions to pass the necessary rules and regulations or repeal redundant rules and regulation related to the General Policies Pertaining to Article 44 of the Constitution.

10. Handling all other tasks assigned by the relevant authorities.

Group for Supervision and Follow-up

Dispatching invitations; organizing regular meetings with all government ministries and institutions and other related bodies in order to follow-up on the proper implementation of the law; preparation of the meeting agenda; summarizing the discussions and decisions of the meetings; and forwarding them to the mentioned officials.

1.      Continually following-through with the executive bodies in charge of handling the decisions and decrees of the executive laws of the General Policies Pertaining to Article 44 of the Constitution.  Also, creating an information bank [to archive and report] the activities of the mentioned bodies.

2.      Drafting and editing reports on the efforts and operations of executive bodies with the purpose of exchanging ideas with and obtaining information from them, and issuing the decisions of the meetings to them.

3.      Creating an information bank of the representative liaisons of executive bodies handling the General Policies Pertaining to Article 44 of the Constitution.

4.      Continuous and periodic follow-up and communication with all bodies under the law to ensure that all assignments and responsibilities outlined in the rules and regulations for implementing the General Policies Pertaining to Article 44 are respected.

5.      Preparing and providing regular, periodic, and itemized supervisory reports on the proper implementation of the law for other supervisory officials.

6.      Cooperating to draft executive monitoring indicators and supervision of reaching the goals of the general policy outlines of Article 44 of the Constitution.  Collecting the necessary information in this area from executive bodies.

7.      Presenting reports on progress, results, related milestones, and indicators of the proper implementation of the General Policies Pertaining to Article 44 of the Constitution.  Also, cooperating to create and utilize a comprehensive system for [recording] these indicators.

8.      Handling of all tasks assigned by the relevant authorities.
